DEFINITIONS
- In this Bylaw:
- “Chief Officer” means the Chief of the Annapolis Royal Volunteer Fire Department or a person designated, in writing, to act in his or her absence or on his or her behalf;
- “Holiday” means a Sunday or a Statutory Holiday designated as such by the Province of Nova Scotia or by the Town of Annapolis Royal;
- “Town” means the Town of Annapolis Royal;
- “Water Source” means an adequate source of water and, without limiting the generality of the foregoing, would include a garden hose, a 160-litre (45 gallon) drum of water, a water tank, a fire hydrant, a river, a lake, estuary or the ocean.
PERMITS
- No person shall light, ignite or start, or cause to be lighted, ignited or started, a fire of any kind whatsoever outside of the confines of the walls of a structure, without having first obtained a Burning Permit from the Chief Officer.
- Notwithstanding Section 2, a Burning Permit is not required for the following:
- A fire confined to a grill or barbeque structure or an appliance for the purpose of cooking food;
- A fire wholly contained within a non-combustible container and confined to materials which are non-hazardous to the health or safety of the public;
- A fire placed a reasonable and safe distance from dwellings, shops, barns, roadways, etc. For the purposes of this provision, a reasonable and safe distance is 30.48 meters (or 100 feet).
- A Burning Permit shall be issued only in relation to the burning of clean wood waste, natural brush, cuttings or lawn rakings.
- All Burning Permits shall be obtained by application to the Chief Officer. The application for a Burning Permit shall be made in writing, on such form as may be specified by the Town from time to time, and signed by the person applying therefore. Every application for a Burning Permit shall contain the following information:
- Name of Applicant (s);
- Mailing address of Applicant (s);
- Telephone Number of Applicant (s);
- Declaration of ownership of Lands briefly described;
- Location of the Lot (Civic Address or subdivision name and lot No.);
- Type of Material Proposed to be Burned;
- Time of day during which burning is planned - After 6 p.m. only;
- Description of the location on the Lot or Parcel of land where the burning is proposed to take place;
- Description of distance of proposed burning location from the nearest adequate source of water;
- Names of 2 or more individuals who will be attending the fire;
- Telephone number and address of the individual responsible for extinguishing the fire.
CONDITIONS RELATING TO BURNING TIMES
- The following conditions shall be attached to each permit:
- From March 1 to November 1 inclusive, no burning will be allowed from 12:01 a.m. to 5:59 p.m. Monday to Sunday inclusive, including holidays.
- Before or after the period from March 1 to November 1 of any year, no person shall initiate a burn without first discussing the burn with the Chief Officer and complying with any direction received.
OTHER CONDITIONS
- The following conditions shall be attached to each permit:
- No materials other than clean wood waste, natural brush, cuttings or lawn rakings are to be burned;
- A fire shall not be lighted, ignited or started within 10 meters of a residence;
- A fire shall not be started when the wind is gusting;
- Sufficient help must be engaged, and care taken, to prevent the fire from spreading;
- Every fire shall be attended at all times, by a competent person, until completely extinguished;
- The person attending the fire shall have at hand adequate fire extinguishing apparatus.
- A permit may only be granted for a period of one week.
- No burning may occur within 100 meters of woods, brush, etc.
REFUSAL

- The Chief Officer may refuse to issue a Burning Permit for any burning which would be a hazard to the health or safety of the public.
- Without restricting the generality of the foregoing, the Chief Officer may refuse to issue a Burning Permit when wind conditions indicate there is danger of the fire spreading, or when smoke from the proposed burning may cause a nuisance or health hazard to the neighbouring public or when no adequate water source is available in acceptable proximity to the proposed site of burning.
VIOLATIONS
- Any person who fails to obtain a permit or who fails to comply with any permit issued hereunder or any condition of such permit, or any other provision of this Bylaw is punishable on summary conviction by a fine in the amount stipulated at Appendix A and to imprisonment for the number of days stipulated at Appendix A in default of payment.
Payment in Lieu of Prosecution
Any person who is given notice of the contravention may pay to the Town of Annapolis Royal, at the place specified in the notice, the minimum sum provided under the Town’s Payment in Lieu of Prosecution Policy, within 14 days of the date of the notice and shall thereby avoid prosecution for that contravention.
REPEAL
- The Burning Bylaw of the Town of Annapolis Royal, as approved by Town Council on the 15h day of May, 2006 is hereby repealed.
