- Whereas the Council of the Town of Annapolis Royal has deemed that the defecation of dogs on public and private property constitutes a threat to public health and a nuisance,
- The owner of a dog other than a dog that is trained to assist and is assisting a person with a disability, shall remove the dog's feces from public and private property other than the owner's. Failure to remove the dog's feces as required by this section shall be an offense against this bylaw.
- Any person who violates any of the provisions of this Bylaw shall be liable upon conviction for each offence to a penalty of not less than $50.00 and not more than $165.00, and in default of payment, to imprisonment for a period of not less than five (5) days and not more than thirty (30) days.
- For the purposes of this Bylaw, “owner” is defined as any person who has the control of or who harbours a dog or, in the case of a person who is a minor, includes the person who is responsible for custody of the minor.
- This bylaw applies to all properties within the limits of the Town of Annapolis Royal and is effective the date of publishing.
Arrest Without Warrant
- A police officer or any law enforcement officer may arrest without warrant a person whom he finds committing an offence or has reason to believe has recently committed an offence against this Bylaw.
